Pour la libération et l’obtention du droit d’asile de S.H.A. (18 ans), actuellement nourri de force dans une prison néerlandaise, après sa grève de la faim. Si son appel est rejeté mardi prochain (28 novembre 2017), il sera déporté en Afghanistan dans la foulée.
En 2015, âgé de 16 ans, S.H.A. a fui une situation de guerre avec l’ensemble des habitant·es de son village en Afghanistan.
Ayant été séparé de sa famille, il est arrivé aux Pays-Bas où il a déposé une demande d’asile qui a été refusée deux mois plus tard. Sans doute pour éviter de se voir accuser de déporter des enfants dans un pays en guerre, les autorités néerlandaises ont attendu ses 18 ans pour lui signifier son renvoi prochain en Afghanistan.
Sans nouvelles de sa famille depuis deux ans, S.H.A., qui est d’une minorité connue pour être persécutée en Afghanistan (Hazara), décide de venir en France pour obtenir l’asile.
En arrivant à Paris, il survit pendant un mois à la rue, devant le centre de premier accueil de la Porte de la Chapelle. Quand il y est finalement accueilli, il est envoyé dans le Loiret où il est assigné à résidence. Persuadé d’être enregistré comme demandeur d’asile, pendant un mois et demi, il se rend deux fois par semaine « pointer » au commissariat. Personne n’a pris le temps de lui expliquer qu’il a en fait été placé en « procédure Dublin III ». En vertu d’un accord entre les pays Européens, signé à Dublin, la France estime qu’elle n’a pas à traiter sa demande d’asile, car il a déjà déposé une demande aux Pays-Bas. Sans qu’il s’en doute, la France s’apprête donc à le renvoyer au Pays-Bas. En aout 2017, il est arrêté à l’occasion d’un de ces pointages au commissariat et est enfermé en centre de rétention administrative (CRA).
La France déploie un acharnement remarquable à se débarrasser de ce très jeune homme. Cinq fois, il sera emmené à l’aéroport. Les quatre premières déportations sont annulées, par sa résistance, par notre présence à l’aéroport pour alerter les passager·es, une fois par la météo ou par défaut d’escorte. Le 45ème et dernier jour légal de sa rétention, alors qu’il s’apprête à ressortir enfin libre, il est finalement embarqué par surprise, à 5 heures du matin. Il parvient à nous prévenir, mais notre présence à l’aéroport ne permet pas cette fois d’empêcher son renvoi forcé vers les Pays-Bas.
Arrivé aux Pays Bas, il est à nouveau emprisonné (au Detention Centrum Rotterdam- numéro d’enregistrement VNR 2820567536), complètement isolé. Les services néerlandais de l’immigration le condamnent au choix suivant : la prison sur place ou la déportation en Afghanistan. Depuis les Pays-Bas où nous avons alerté les organisations militantes, nous avons appris qu’après 12 jours de grève de la faim et de la soif, il a été placé sous ‘alimentation forcée’ dans une unité judiciaire de soins somatiques, comme les détenu·es de Guantanamo.
Avant sa grève de la faim et de la soif, S.H.A. avait fait appel du refus d’asile. Il sait cependant que cet appel a peu de chance d’aboutir favorablement, ce que les organisations militantes sur place nous confirment.
Arrivé en Europe à 16 ans, avec l’espoir d’y trouver sécurité et protection, S.H.A. se retrouve emprisonné et menacé d’être renvoyé dans un pays en guerre où il n’a plus aucune attache. Faut-il rappeler les conditions de « sécurité » en Afghanistan, les attentats kamikazes hebdomadaires, les meurtres, les vendettas, l’Etat corrompu, les bombardements américains ayant fait en 2017 seulement 466 victimes civiles, pour la majorité des enfants ? Nous citerons simplement les conseils aux voyageurs de l’Ambassade française, d’un cynisme sans borne : « La situation de sécurité en Afghanistan demeure très dégradée, fragile et instable », « à Kaboul, le risque terroriste reste très élevé. », ou encore : « Dans ces conditions, tous les déplacements en Afghanistan restent formellement déconseillés. » (Source : https://www.diplomatie.gouv.fr/fr/conseils-aux-voyageurs/conseils-par-pays/afghanistan/
Nous savons que les semaines de rétention en France, les différentes tentatives de déportation, puis le nouvel enfermement aux Pays Bas l’avaient fortement fragilisé. Nous n’avons plus de nouvelles de lui depuis son placement en unité judiciaire de soins somatiques.
Nous demandons sa libération au plus vite et que cesse le traitement inhumain et cynique d’un maintien en survie par alimentation forcée sous la menace d’un renvoi en Afghanistan.
Nous demandons aux autorités néerlandaises de reconnaître son droit à la protection en lui accordant un titre de séjour.

We demand the immediate release of S.H.A. and the recognition of his right to asylum. S.H.A. is currently being detained in a Dutch prison hospital as a result of his hunger strike. He risks being deported if his appeal is rejected next Tuesday (November 28, 2017).
In 2015, S.H.A., then just 16 years-old, fled the war in Afghanistan with all the inhabitants of his village. During the journey, he was separated from his family. He arrived in the Netherlands alone and applied for asylum. Two months later, he was denied asylum. However, the Dutch authorities patiently waited for him to turn 18. As soon as he was considered an adult, he was notified that he would be deported to Afghanistan. He had no news from his family, members of the Hazara ethnic minority which have been persecuted throughout history in Afghanistan.
He decided to flee to France and to seek asylum there. In Paris he lived for a month on the streets, just next to the so-called “humanitarian” reception center at Porte de la Chapelle, before he was allowed to enter. He was then sent him to the Loiret region, immediately placed under house arrest and had to sign in twice a week at the police station.
He thought, however, that he had been registered as an asylum seeker. No one ever told him he was a victime of the Dublin III Accords. The French authorities refused to examine his asylum claim because he had already applied for asylum in the Netherlands. No one informed S.H.A. that the French authorities were preparing for his forced deportation to the Netherlands. He was arrested in August 2017 at the police station where he routinely signed in and was transferred to an administrative detention center (CRA) for 45 days maximum.
France was very determined to deport this young man. He was taken five times to the airport. The first four deportations were eventually canceled: because of his resistance, because we went to the airport to alert the passengers, once because of the weather, and once because the police could not arrange the escort. The 45th day of detention should have been his last one, but the police came to get him at 5 a.m.. Despite his own and our efforts, he was forcibly deported to the Netherlands.
Upon his arrival, he was arrested and imprisoned by the Dutch authorities (in the Detention Centrum Rotterdam – Registration Number VNR 2820567536). He was left completely isolated. The Dutch migration services offered him to choose between the prison or the deportation to Afghanistan.
Activist organizations in the Netherlands informed us that he had begun a hunger and thirst strike. After 12 days, the Dutch authorities brought him to the Judicial Centre for Somatic Concern (the prison hospital) in The Hague. They started to force feed him, just like the prisoners in Guantanamo.
S.H.A. filed an appeal to the Dutch decision to deny him asylum. He knows, however, that this appeal is unlikely to succeed. The activist organizations are also very pessimistic.
When he arrived in Europe, S.H.A was a child. He came in search of security and protection. He is now being detained, and under the threat of a deportation to a war-torn country, with which he no longer has any ties.
Is it necessary to recall the “security” conditions in Afghanistan, the weekly suicide attacks, the murders, the vendettas, the corrupt state? In 2017 only, American bombings have so far killed 466 civilians, most of them children. The weeks of detention in France, the attempts at deportation and now his detention in the Netherlands have considerably weakened S.H.A, to say the least. We have not heard from him since his placement in the police medical unit.
We request his immediate release and an end to this inhuman and cynical treatment. We ask that the Dutch authorities recognize his right to protection and grant him a residence permit.
